Fash-art Statement of Rights and Responsibilities

This statement is made by the Fash-art community website which is operated by Fash-art Inc. , and governs our relationship with members and others who interact with Fash-art. By using or accessing fash-art, you will understand and agree to this statement.
Fash-art Inc. reserves the right to modify and amend to these terms of use from time to time, for any reason, and without prior notice; the use of the website as a member indicates your acceptance of any changes. You are responsible for regularly reviewing these terms of use.

Fash-art Inc. reserves the right to suspend or terminate, at our discretion, a member's account for violations of our rules, guidelines, or terms of use.

1.    Membership conditions:

Some parts of the website are entirely reserved to the members.

There are 2 ways to become a member. You can either be directly invited by a trusted member or send a membership request with your complete information, then after being approved by Fash-art, an invitation will be sent to your email address.
Members are trusted therefore they have to invite only respected people that belong to this community (artists, designers, art lovers, etc...).

Members may not use any pseudonym or alias, their real names are required.

Fash-art members have to be at least 16 years old.

Members will keep their contact information accurate and up-to-date.

Members will not share their passwords, let anyone else access their accounts, or do anything else that might minimize or violate the security of their accounts.

Members understand that they have to be respectful to the other members and the public, and put only legally acceptable contents on the website.

By having an account on Fash-art.com you agree to the fact that you will not be able to transfer your account to anyone else, and will not have the right to sell invitations.
Our community is based upon the assumption that all information you provide regarding yourself and your professional situation is truthful and accurate. Misleading or false information is a sufficient reason for us to delete your account.

Fash-art Inc. reserves the right to change or adjust membership criteria and to make changes in the existing membership at any time and without prior notice.

All members are free to delete their account anytime and as a result,  their profiles will be erased from the website. However, they should know that some of their interventions on the website's PeopleWatch, such as the forums and events, will still appear on these website thereafter.

2.    Conditions of use:

Fash-art is a fashion, art and design community website that provides a platform for networking and sharing information.

If some members enter into agreements with other members through Fash-art, we are not a contracting party to these agreements and cannot be held liable or accountable regarding these agreements. Moreover, all of the items for sale posted by the members on the Marketplace are not managed by Fash-art Inc (if Fash-art Inc. does not have any particular contract with the member). It means that all the processes and payments will occur without Fash-art's approval and will not be under Fash-art Inc.'s responsibility.
Fash-art does not endorse, support, or ensure the accuracy, truthfulness, or reliability of any content posted on the website's forum, the PeopleWatch, the marketplace or elsewhere. Fash-art does not support opinions mentioned by its members on the website.

2.1.Expose your work, pictures and events, or other:

You should fully understand and be aware that all the information you put on the site (except the private account information) will be exposed on different search engines (such as Google), since the goal of the website is to provide exposure to its members. You agree that your personal status and company status will appear on the PeopleWatch located on the homepage of Fash-art. Furthermore, some of your picture uploads will also appear on  PeopleWatch, as well as the events that you publish on the website. You understand and agree to the fact that you cannot erase any content on PeopleWatch.

  2.2. Sharing information and contents

You own all of the content and information you post on Fash-art.

You acknowledge the right to use these contents, pictures and information.
You understand that removed contents may persist in backup for a longer period of time.


3. Safety

We are trying to keep Fash-art as safe as possible, nevertheless we cannot guarantee the complete safety.

You will not send or otherwise post unauthorized commercial communications (such as spam) on Fash-art.

You do not have a right to:

-    facilitate or promote any violations of this Statement.

-    participate in unlawful multi-level marketing on Fash-art, such as a pyramid scheme, .

-    upload viruses or other malicious code.
-    gather users' content or information, or access Fash-art by using automated means, such as harvesting bots, robots, spiders, scrapers, etc...
-    request someone's login information or access an account belonging to someone else.
-    bully, intimidate,verbally abuse, or harass any member.

-    place any intolerable content that might be hateful, threatening, discriminating, pornographic, or which contains nudity or graphic violence.

-    develop, manage, advertise or otherwise market a third party application that contains alcohol-related products or other mature content without appropriate age-based limitations.
-    offer any contest or giveaway on Fash-art without our prior written consent. If you obtain our consent, you will take a full responsibility for the promotion, and you must follow our Promotions Guidelines and all other applicable laws.
-    use Fash-art to do anything against the law, or that can be misleading, malicious, or discriminatory.
-    do anything that could disable, overload, or impair the proper functioning of Fash-art,  such as a denial of service attack.

Fash-art respects other people's rights, and expects its members to do the same.

        - You must not post content or take any action on Fash-art that infringes someone else's rights or otherwise violates the law.
        - We have the right to eliminate any content or information that you post on Fash-art, if we believe that it breaches this statement.

         - If you repeatedly violate other people's intellectual property rights, we will disable your account when appropriate.
        - You must not use our copyrights or trademarks (including Fash-art, the FA logo and PeopleWatch), or any confusingly similar symbols, without our written permission.
         - If you choose to collect information from other users, you must obtain their consent that you (and not Fash-art) are the one collecting their information. You must additionally post a privacy policy explaining what information you will be collecting and how do you plan to use it.
         - You must not post anyone's identification documents or any sensitive financial information on Fash-art.
         - You must not use, display, or share user's data in a manner that is inconsistent with the user's privacy settings.
- You must not give us information that you independently collect from a user or a user's content without that user's consent.
            - Fash-art has the right to issue a press release that describes our relationship with you.
             - We have the right to expose your profile and/or work (marketplace, gallery, portfolio, etc...) on other supports and websites.

- You may not distribute, display or publish in any form (electronic or print) content from the website or the names of any members without our expressed consent, nor can you share, transmit or sell any content of the website with anyone who is not a member of Fash-art, for whatever reason.


Some jurisdictions do not allow the exclusion or limitation of implied warranties, thus the above disclaimers and exclusions may not apply to you. You agree that your use of Fash-art  is entirely at your own risk. You agree to hold harmless and indemnify Fash-art from and against any third-party claim arising from or in any way related to, your use of our services and website. This includes any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of any kind and nature.

These terms and conditions will be governed in accordance with laws of Quebec, Canada.
